Welcome to The Durant Arms website. The following terms and conditions (T&Cs) apply to this website, please read them carefully, as they affect your rights and liabilities under the law. If you do not agree with our terms and conditions then please do not continue to use this website.

 

1.The use of this website

This website is provided free of charge for your personal use; if you continue to browse and use our website then you agree to be bound by and to comply with our T&Cs which, together with our privacy policy, govern Woollacott Inns Limited trading as The Durant Arms and our relationship with you in regards to this website.

The terms ‘Woollacott Inns Limited’, or ‘The Durant Arms’, or ‘us’, or ‘we’ refers to the owners of the website: Company number: 08753736; VAT number: 173 7644 82; Registered office: The Durant Arms, Ashprington, Totnes, Devon TQ9 7UP.

The term ‘you’ or ‘your’ refers to the user or viewer of this website.

 

2. Availability of our website

We will make every effort to make our website available to you 24 hours per day but this cannot be guaranteed due to circumstances beyond our control, such as internet connectivity, essential maintenance by us, updates to the website, or a failure of your own system.  Therefore, we do not accept any liability for disruption to the availability of our website.

 

3. Access to our website

Access to our site is allowed on a temporary basis only, and we reserve the right to withdraw or amend the service provided without notice.  During your access to The Durant Arms website you shall not interfere or attempt to interfere by any means or device with the operation of the website, or with any third party involved in the creation, production and hosting of this website or the use of the website by others. You agree not upload any malware that would infect or damage our site including, but not limited to, computer viruses, Trojans, spyware, worms, ransomeware, adware or bonets.

 

4. Liability

Woollacott Inns Limited aim to ensure that the information is accurate at the time inclusion on the website, we cannot be certain that the information is totally accurate or up to date and accept no liability in respect of any mistakes that may have been made.  We reserve the right to amend or change the information.  However, our website is provided without any warranty or guarantee. We have taken reasonable precautions to ensure that our website is as secure as possible, and you have made the choice to use our website and do so at your own risk.

We disclaim all liabilities that relate to the following: incompatibility of our website to operate with any or your equipment, the inadequacy of this site to meet your requirements, technical problems including errors or interruptions to the website, loss or damage to data arising out of the use of or your inability to use this site, or unsuitability to meet your needs.

By accessing our website you agree that we shall not be held liable to any person for any losses costs or expenses of any kind, or for any damages whatsoever whether direct, indirect or incidental from your access to our website or by your downloading of any material including, without limitation, anything introduced by malware.

Nothing in these T&Cs affects our liability for death or personal injury arising from our negligence neither does it apply to our liability in respect of products sold through The Durant Arms.

Failure on our part to exercise our rights immediately must not be taken as a waiver of our rights and we may exercise our rights in the future. Your use of this website and any dispute arising out of the website is subject to the laws of England and Wales.

 

5. Your liability and responsibilities

You agree to be liable for and to indemnify Woollacott Inns Limited (including employees, directors, shareholders, agents, and information providers) and to hold us harmless from all third-party claims, demands and actions and against any and all liability (including all legal fees and costs) incurred in relation to any claim to the extent that such liability arises from the beach of our T&Cs by you, or by the use of your device or computer and passwords by an unauthorised user. You agree not to use our website for any unlawful purpose, not to submit or publish false or inappropriate information or make any misrepresentation that could damage or threaten us or any third party, including the submission of racially, ethnically or gender offensive material.

 

6. Intellectual property

All of the content of the pages of this website is subject to copyright (Woollacott Inns Limited © 2019).  You are welcome to print pages or display pages on a computer screen for your personal use on condition that you do not alter any of the content. No part of this website, our logo or trademark (whether registered or not) may be reproduced and or transmitted in any way or used for any other purpose. Any unauthorised use of this material would run the risk of penalties or liability for damages including, without limitation, anything related to violation of copyright, trademarks, privacy or passing-off.

 

7. Gift voucher conditions of use

  • Gift vouchers may be purchased for any amount above £10.00.
  • A Durant Arms gift voucher cannot be exchanged for cash.
  • No change will be given after use of a voucher but any credit may be used for future purchases.
  • A gift voucher is valid for 12 months from the date of purchase.
  • To use a gift voucher for dining please pre-book a table and quote the gift voucher number.
  • We do not accept responsibility for lost vouchers and advise that you protect them as cash.
  • We reserve the right to amend T&Cs.

 

8. Accommodation

Prices quoted are per room per night and are inclusive of VAT.

Check in/out: Reserved rooms are usually available from 2pm and should be vacated by 10am, please advise at the time of booking if you require any variance of this.  If you intend to check in outside pub opening hours please inform us to enable arrangements for key collection to be made.

We offer two options to make a reservation to stay at The Durant Arms:

i). Via a link on our website www.durantarms.co.uk using option ‘STAY’ this connects to a trusted third party: https://www.toprooms.com with their own T&Cs and privacy policy. We do not have any control over this website, hosted by eviivio Limited, and we advise that you read, understand and accept, if you agree, to their T&Cs before making a booking to stay with us. We are not responsible for the privacy policies of this third party, and we shall not be liable for their data protection policies and practices.  n the event that you need to cancel a reservation for accommodation made through toprooms.com this must be initiated with them on-line via their booking management system.  Charges may apply according to how close your day of arrival is due. We regret that we are unable to cancel this method of reservation on your behalf.

 

ii) Via a direct telephone booking with The Durant Arms (Tel: 01803 732240) and in acceptance of our T&Cs listed below:

  • By requesting to book accommodation you warrant that you (The Lead Customer) are legally capable of entering a binding contract, that you are at least 18 years old, and have the requisite consent or authority to act for or on behalf of any persons included in a booking.
  • The Lead Customer must also ensure and confirm that the details provided for all parties to the booking are full and accurate, that all parties agree to be bound by these T&Cs and that the Lead Customer has the authority to accept and does accept these T&Cs on behalf of all customers in the booking.
  • The Lead Customer is the person responsible for all matters concerning the booking, paying the deposit and the full price, making any amendment and cancellation requests, and for payment any additional charges in relation to the booking, such as smoking damage* or damage to bed linen and property. We reserve the right to charge a minimum of £50 for any specialist cleaning
  • required incurred during your stay. *Please note The Durant Arms has a strict no-smoking and no-vaping policy throughout the premises.
  • The Booking Confirmation, which includes a description of the room and the price, will be sent to The Lead Customer by e-mail. If The Lead Customer does not receive a Booking Confirmation e-mail within 24 hours of placing the booking, they should contact The Durant Arms, telephone 01803 732240 or email info@durantarms.co.uk to enable us resolve the issue.
  • The Lead Customer agrees to check all details on the email booking confirmation following a direct telephone reservation and to inform us immediately of any errors. No booking is binding on us until you have received a confirmation email.
  • At our discretion, and only by prior arrangement at the time of booking, you are welcome to bring your well-behaved dog with you to The Durant Arms for a charge of £5.00 per animal per night (maximum two dogs), guide dogs and assistance dogs are exempt from this charge.
  • In the interest of hygiene and the comfort of other guests, animals must not be allowed on the beds or furniture. You agree not to leave your dog unattended in the bedroom or allow it to foul the premises inside or out. Dogs must be kept on a lead inside the building, and unacceptable behaviour or excessive noise will not be tolerated. The dog owner will be liable for and must agree to accept any subsequent charges (minimum charge £50.00) levied on or after departure for any damage sustained to the property caused by your pet should there be a need for any specialist cleaning.
  • We accept payment for accommodation by the following methods: a valid credit or debit card or cash with evidence of identification (e.g. a valid driving licence). In most cases you will be asked to pay when you check in to ensure a quick and easy departure when you leave. For arrivals when the bar is busy payment may be made any time during your stay or on your departure which, with our prior agreement, must include any outstanding bar or restaurant bill.
  • A cancellation is free of charge up to 48 hours prior to your arrival time, after this time if you cancel your reservation within 48 hours of arrival you will be charged for the first night, and cancellation within 24 hours of arrival will result in the full cost of the stay being charged. We advise all our guests to ensure they have adequate Travel Insurance.
  • It is expressly agreed that the data stored in the information system of The Durant Arms shall constitute proof with respect to the bookings made by The Lead Customer. Data stored in computers or electronic media are valid proof and shall therefore be acceptable under the same conditions and with the same evidential value as a physical written document.
  • Access to The Durant Arms, access to our 3 en-suite bedrooms is via a flight of stairs; there are no bedrooms on the ground floor. Also, in the bar area and between the dining areas there are single steps and we advise you to discuss your individual needs with us prior to making a booking to assess suitability for you.
  • Parking is on-street in the village and on a first come first served basis and therefore cannot be reserved. We recommend that you drop off anyone with limited mobility at the front door before parking your car.

 

9. Linking to or from our website.

Any links to other another websites or businesses that we may provide are added for your convenience and are not endorsed by us. These links are to websites provided by third parties who operate with their own privacy policies and T&Cs and which we have no control. Using a link to another website is therefore at your own risk and we disclaim any responsibility to any and all warranties and any material contained on any other site. We reserve the right to withdraw any link from our website without notice.

Should you wish to link to our website then this may only be done at our sole discretion and in such a way that such a link to us would be done in a fair and legal way, only to a website that is owned by you, and that any link agreed would not damage our reputation, or suggest any approval or endorsement on our part of your website/product. We reserve the right to withdraw linking permission without notice.

 

10. Complaints, comments or questions

It is our aim to deliver 100% customer satisfaction at all times, however we do recognise that sometimes our guests can feel let down, unsatisfied, or have areas that they would like us to improve on. We would welcome that if issues arise that they are discussed with us during your stay/visit in order to resolve the problem. Alternatively, we also like to hear about your good experiences and any members of staff or area or service you feel deserves mentioning.
